Terms and Conditions

1. Who TinyMail is for

TinyMail is a discovery and listing platform for snail mail clubs. It helps members browse clubs and helps club owners manage public listings, page content, and waitlist signups.

You must be at least the age of majority where you live to use TinyMail, or have permission from a parent or legal guardian. If you use TinyMail for a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Accounts and security

• You are responsible for activity under your account and for keeping credentials secure.
• You must provide accurate, current information and keep it updated.
• You may not share accounts or impersonate others.
• We may require verification, suspend access, or reclaim usernames/slugs to prevent abuse, fraud, or confusion.

3. Platform role and third-party services

TinyMail is a platform and does not own or operate the third-party clubs listed on the site. Club owners are solely responsible for their offers, communications, subscription fulfillment, and legal compliance.

TinyMail may link or redirect to third-party sites and services (including external checkout pages and social platforms). We do not control third-party services and are not responsible for their content, policies, uptime, or practices.

4. Paid plans, billing, and cancellations

• Club owner plans are paid subscriptions billed through Stripe or another payment processor we choose.
• Pricing, plan features, renewal cadence, and taxes are shown at checkout or in your billing portal.
• Subscriptions renew automatically unless canceled. You can manage cancellation from the billing portal.
• Except where required by law, fees are non-refundable and we do not provide partial-period refunds or credits.
• If payment fails, is reversed, or a subscription lapses, we may limit features, unpublish listings, or mark listings inactive.

5. User content and licenses

You keep ownership of content you submit to TinyMail, including listing text, images, profile details, reviews, and other materials ("User Content").

You grant Beachski Studios a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting and technical delivery), display, and distribute User Content as needed to operate, secure, improve, and promote TinyMail.

You represent and warrant that you have all rights needed for your User Content and that it does not violate law, third-party rights, or these Terms.

6. Prohibited conduct

You agree not to:

• Post unlawful, infringing, deceptive, defamatory, abusive, hateful, or fraudulent content.
• Spam users, scrape data at scale, or use bots to abuse the platform.
• Bypass security, probe vulnerabilities, or interfere with platform performance.
• Upload malware or harmful code, or attempt unauthorized access.
• Misrepresent club offerings, pricing, status, or your identity.
• Use TinyMail in violation of applicable law, including privacy and consumer laws.

7. Waitlists, reviews, and reports

If you submit an email to a club waitlist, you authorize TinyMail to process and share that signup with the applicable club owner. Club owners are responsible for how they use waitlist data after receiving it.

Reviews and reports are user-submitted content. We may moderate, remove, or restrict content that violates these Terms or creates risk to users or TinyMail.

8. Enforcement and termination

We may investigate violations and, at our discretion, remove content, disable listings, suspend accounts, terminate access, or take other action with or without notice.

You may stop using TinyMail at any time. Sections of these Terms that by nature should survive termination will survive, including payment obligations, licenses, disclaimers, liability limits, indemnity, and dispute terms.

9. Intellectual property

TinyMail, including its software, design, branding, and non-user content, is owned by Beachski Studios LLC or its licensors and protected by intellectual property laws. Except as expressly allowed by these Terms, no rights are granted to you.

If you send feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free right to use them without restriction or compensation.

10. Copyright complaints

If you believe content on TinyMail infringes your copyright, contact us at hello.tinymail.club@gmail.com with enough detail for us to identify the work and the allegedly infringing material.

11. Disclaimers

TinyMail is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free.

We do not guarantee the accuracy of club listings, user reviews, waitlist outcomes, or results from using TinyMail.

12. Limitation of liability

To the maximum extent permitted by law, Beachski Studios LLC and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption.

Our total liability for claims arising out of or relating to TinyMail will not exceed the greater of (a) amounts you paid us for TinyMail in the 12 months before the event giving rise to the claim, or (b) $100 USD.

13. Indemnification

You agree to defend, indemnify, and hold harmless Beachski Studios LLC and its affiliates from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your use of TinyMail, your User Content, your club offerings, or your violation of these Terms or applicable law.

14. Disputes, governing law, and venue

These Terms are governed by applicable U.S. law and the laws of the state where Beachski Studios LLC has its principal place of business, without regard to conflict-of-law rules.

Before filing a claim, you agree to first contact us and try to resolve the dispute informally. If a dispute is not resolved, exclusive venue will be in the state or federal courts located where Beachski Studios LLC has its principal place of business, and each party consents to personal jurisdiction there.

15. Changes to TinyMail or these Terms

We may modify TinyMail or these Terms at any time. When we update these Terms, we will update the "Last updated" date on this page. Your continued use of TinyMail after changes become effective means you accept the updated Terms.

16. General terms

• If any provision of these Terms is unenforceable, the rest remain in full force and effect.
• Our failure to enforce a provision is not a waiver of any right to enforce it later.
• You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or asset sale.
• These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding TinyMail.
